1. Agreement to Terms

Welcome to WedMuse. These Terms of Service ("Terms") govern your access to and use of our web application and website (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Eligibility

You must be at least 18 years old to use WedMuse. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

The Service is intended for individuals planning weddings. You may not use the Service for any commercial purposes without our prior written consent.

3. Account Registration

To use certain features of the Service, you must register for an account using Google Sign-In. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, fraudulent, or violates these Terms.

4. Subscription Plans and Billing

4.1 Subscription Plans

WedMuse offers the following subscription plans:

• Weekly Plan: $9.99 per week (10 photos/week)
• Wedding Plan (Annual): $179.99 per year (30 photos/month rolling)

One-time photo packs are also available:

• Quick Top-Up: 10 photos for $9.99
• Bridal Bundle: 35 photos for $29.99
• Mega Bundle: 85 photos for $69.99

All subscriptions provide full access to AI-powered image generation, vision board creation, wedding planning tools, and venue recommendations.

4.2 Billing and Payment

• Subscription fees are billed in advance on a recurring basis (weekly or annually)
• On iOS, payment is processed through Apple In-App Purchase and managed by RevenueCat. On the web, payment is processed securely through Stripe
• You authorize us to charge your payment method on file for the applicable subscription fee
• If payment fails, we will attempt to process payment again. After multiple failed attempts, your subscription may be suspended
• All fees are in U.S. Dollars (USD) unless otherwise stated
• Prices are subject to change with 30 days' notice

4.3 Free Trial

We may offer a free trial period for new subscribers. If offered, the free trial terms will be disclosed at the time of sign-up. After the free trial, you will be automatically charged unless you cancel before the trial ends.

4.4 Automatic Renewal

Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. On iOS, you can manage your subscription in Settings → Apple ID → Subscriptions. On the web, you can manage your subscription through the Stripe billing portal in your account settings.

5. Cancellation and Refunds

5.1 Cancellation

You may cancel your subscription at any time through your account settings or the Stripe billing portal. Cancellation will take effect at the end of your current billing period, and you will retain access to paid features until that date.

5.2 Refund Policy

All subscription fees are non-refundable except as required by law. We do not provide refunds or credits for partial months or years of service, or for unused subscription time.

Exceptions may be made on a case-by-case basis for:

• Technical issues that prevent you from using the Service for an extended period
• Billing errors or duplicate charges
• Service cancellation within 48 hours of initial purchase (one-time courtesy refund)

5.3 Account Termination

If we terminate your account for violation of these Terms, you will not be entitled to any refund.

6. Photo Consent and Third-Party Rights

WedMuse allows you to upload photos of yourself and others for AI image generation. By uploading photos, you represent and warrant that:

• You have obtained explicit consent from every identifiable person whose photo you upload to the Service
• Each person has been informed that their likeness will be used for AI-powered wedding image generation
• You are solely responsible for obtaining and maintaining such consent
• You will immediately remove any person's photos if they withdraw their consent

WedMuse is not responsible for any claims arising from your failure to obtain proper consent. You agree to indemnify us against any claims from third parties whose photos you uploaded without authorization.

7. Acceptable Use and Prohibited Content

You agree not to use the Service to:

• Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Generate or attempt to generate non-consensual intimate imagery (NCII) of any person
• Generate images depicting minors in any inappropriate context
• Upload photos of any person without their explicit consent
• Use generated images to harass, deceive, defraud, or harm any person
• Create deepfakes or misleading content intended to deceive others
• Infringe on any intellectual property rights of others
• Upload content containing viruses, malware, or other harmful code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use the Service for any commercial purposes without permission
• Reverse engineer, decompile, or disassemble the Service
• Use automated systems (bots, scrapers) to access the Service
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the Service or servers

WedMuse is a wedding visualization tool only. Any attempt to generate explicit, violent, or non-consensual content will result in immediate account termination and may be reported to law enforcement.

We reserve the right to remove any content that violates this policy and to suspend or terminate accounts that engage in prohibited activities.

8. Content and Intellectual Property

7.1 Your Content

You retain ownership of any photos, text, or other content you upload to the Service ("Your Content"). By uploading Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and process Your Content solely for the purpose of providing the Service to you.

You represent and warrant that:

• You own or have the necessary rights to upload Your Content
• Your Content does not infringe on any third-party rights
• Your Content complies with these Terms and applicable laws

7.2 AI-Generated Content

Images generated by our AI service using Your Content are owned by you. However, you acknowledge that:

• AI-generated images are created using Google Gemini AI technology
• Similar or identical images may be generated for other users with similar inputs
• Generated images are for personal, non-commercial use only unless otherwise agreed

7.3 Our Intellectual Property

The Service, including its design, features, graphics, and underlying code, is owned by WedMuse and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

9. AI Service Limitations

Our AI-powered image generation is provided "as-is" and is subject to limitations:

• Generated images may not always meet your expectations or accurately reflect your inputs
• Facial likeness in AI-generated images is approximate and may not be 100% accurate. Due to inherent limitations of current AI image generation models, generated faces may differ from the reference photos provided. WedMuse does not guarantee exact facial reproduction and generated images should be treated as artistic visualizations, not photographic representations
• AI technology has inherent limitations and may produce unexpected results
• We do not guarantee the quality, accuracy, or suitability of generated images
• Generated images should be reviewed before use and may require editing
• We are not responsible for any decisions you make based on AI-generated content

10. Fair Use Policy

To ensure sustainable operation and fair access for all users, we implement the following usage limits:

9.1 Monthly Generation Limits

AI image generations are limited by your photo balance. Photos are allocated based on your plan:

• Weekly subscribers receive 10 photos per week (reset each billing cycle)
• Annual subscribers receive 30 photos per month (rolling, up to 40 banked)
• Is designed to accommodate typical wedding planning needs while preventing abuse
• Helps us maintain service quality and manage operational costs

9.2 Photo Balance and Enforcement

To help you manage your usage:

• Your remaining photo balance is visible in the app at all times
• You will receive a warning when your photo balance is running low
• When your photo balance reaches zero, you will not be able to generate new images until your next renewal or by purchasing a photo pack
• Annual subscribers may bank up to 40 photos at any time

9.3 Rationale

Photo allocations are carefully designed to be generous for legitimate wedding planning use while preventing system abuse and unsustainable costs. Based on typical usage patterns, most users generate between 10-30 images per month, making these limits more than sufficient for normal planning needs.

9.4 Exceptions

If you have special circumstances requiring additional generations (such as planning multiple events or professional use cases), please contact us at hello.weddingvision@gmail.com to discuss custom arrangements.

9.5 Policy Changes

We reserve the right to adjust usage limits with 30 days' notice based on operational needs, technology improvements, or to better serve our user community.

11. Third-Party Services

Our Service integrates with third-party services, including:

• Google Sign-In: For authentication
• Apple In-App Purchase & RevenueCat: For iOS subscription and payment management
• Stripe: For web payment processing
• Google Places API: For venue recommendations
• Google Gemini AI: For image generation

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.

12. Disclaimers and Limitation of Liability

11.1 Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• Any errors in the Service will be corrected

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEDDING VISION AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of your data
• Any bugs, viruses, or malicious code transmitted through the Service
• Any errors or omissions in content or for any loss or damage incurred from using content posted, emailed, or otherwise made available through the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless WedMuse, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your Content
• Your violation of these Terms
• Your violation of any rights of another party

14. Dispute Resolution

13.1 Informal Resolution

If you have a dispute with us, please contact us at hello.weddingvision@gmail.com to attempt to resolve the issue informally before pursuing formal legal action.

13.2 Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and shall take place in the State of Delaware, United States.

You agree to waive your right to a jury trial and to participate in class action lawsuits.

13.3 Exceptions

Either party may seek injunctive relief in court to protect intellectual property rights or confidential information.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in the State of Delaware.

16. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

17. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms or engage in conduct that we deem inappropriate or harmful.

Upon termination:

• Your right to use the Service will immediately cease
• You will no longer have access to Your Content stored on the Service
• We may delete your account and data after 30 days
• You remain liable for any outstanding fees

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wedding Vision regarding the Service and supersede all prior agreements and understandings.

20. Data Deletion

You may request deletion of your account and all associated data by contacting us at hello.weddingvision@gmail.com. Upon request, we will permanently delete:

• Your account information
• All uploaded photos and wedding data
• All AI-generated images
• Your vision board items
• All personal data associated with your account

Data deletion will be completed within 30 days of your request. Some information may be retained as required by law or for legitimate business purposes (such as financial records for tax compliance).
